Terms of Service

1. Acceptance of Terms

By creating an account, downloading, or using the Prediux mobile application or the website at https://prediux.com (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

The Service is operated under the commercial name "Prediux" ("we", "us", "our"). The full identification of the operator (legal name, tax ID, and registered address) is provided at the end of this document (Section 15 — Contact).

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you are 16 or older. If you are below 16, you are not authorized to use the Service.

3. Description of the Service

Prediux is a mobile application that:

• Collects daily self-reported signals about your execution, energy, and distraction levels.
• Computes a personal vector state representing your control, drift, momentum, and volatility.
• Generates a daily AI directive (title, rationale, plan, projections, and forecast) calibrated to your patterns.
• Sends optional reminders.

The Service is provided "as is" and is intended for personal, informational use only.

4. Not Medical, Psychological, or Professional Advice

The Service does not provide medical, psychological, psychiatric, therapeutic, financial, legal, or other professional advice. It is not a substitute for diagnosis, treatment, counseling, or advice from a qualified professional. The directives, projections, forecasts, and any other content generated by the Service are informational and based on patterns the algorithm detects in your self-reported inputs.

If you experience symptoms of mental-health distress, suicidal thoughts, medical conditions, or any situation that requires professional intervention, seek help from a qualified professional immediately. In the European Union, you can call the EU emergency number 112; in Spain the suicide-prevention line is 024. In the United States, you can call or text 988 (Suicide and Crisis Lifeline) or 911 for emergencies.

You acknowledge and agree that you use the Service at your own risk and that we are not responsible for any decisions, actions, or outcomes arising from your use of the Service.

5. Account Registration

To use the Service, you must create an account using Apple Sign In or Google Sign In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information and to keep it current. You may not use another person's account or share your account with others.

6. Subscription ("Prediux Pro")

Some features require a paid subscription called "Prediux Pro". New subscribers are eligible for a 3-day free trial via Apple's introductory pricing (see Section 6.3). After the trial, full access to AI-generated plans and projections requires an active subscription.

6.1 Pricing and billing

Subscriptions are sold as monthly or annual auto-renewing in-app purchases through Apple's StoreKit (App Store) or Google Play. Prices are displayed in your local currency on the in-app paywall. Eligible new subscribers also receive a one-time 3-day introductory free trial in accordance with Apple's eligibility rules (see Section 6.3).

Payment will be charged to your Apple Account or Google Account at confirmation of purchase. Your subscription automatically renews at the end of each billing period unless you cancel auto-renewal at least 24 hours before the end of the current period. The cost of renewal will be charged within 24 hours prior to the end of the current period. All billing, renewal, cancellation, and refund decisions are governed by Apple's or Google's terms — not by Prediux.

6.2 Cancellation and refunds

You can cancel auto-renewal at any time:

• iOS: Settings → [your name] → Subscriptions → Prediux → Cancel Subscription.
• Android: Google Play Store → Menu → Subscriptions → Prediux → Cancel Subscription.

Cancellation takes effect at the end of the current billing period. You retain access until then.

Refunds are handled exclusively by Apple or Google according to their respective refund policies. We do not process refunds directly. To request a refund:

• iOS: visit reportaproblem.apple.com.
• Android: visit play.google.com/store/account.

6.3 Free trial

Prediux offers a 3-day free trial via Apple's introductory pricing. The trial begins when you tap "Start free trial" in the in-app paywall and confirm with your Apple ID.

Auto-conversion to paid: Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription at the price displayed at the time of purchase, charged through your Apple ID. This is managed entirely by Apple — Prediux does not control the trial duration or the billing conversion.

Cancellation: To cancel before being charged, open the iOS Settings app → tap your Apple ID name → Subscriptions → Prediux → Cancel Subscription. You will retain access through the end of the trial period.

7. Acceptable Use

7.1 Prohibited content

You agree not to submit, post, or transmit through the Service:

• Unlawful, hateful, harassing, threatening, defamatory, or discriminatory content, including content targeting protected characteristics such as race, ethnicity, religion, gender, sexual orientation, disability, or age.
• Content that promotes, encourages, glorifies, or describes self-harm, suicide, eating disorders, or violence against any person or group.
• Sexually explicit content, or any content depicting or involving minors in a sexual or otherwise inappropriate context.
• Personally identifiable information about other people (names, addresses, phone numbers, photos, financial information, health information, or any other identifying detail) in any free-text field, including the "primary avoidance" answer or signal-reason fields.
• Content that infringes the intellectual property, privacy, or other rights of any third party.
• Viruses, malware, or any other harmful code.

7.2 Prohibited conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to reverse-engineer, decompile, disassemble, or extract the source code, models, prompts, or any underlying components of the Service.
• Use automated systems (bots, scrapers, crawlers, or similar) to access the Service.
• Interfere with, disrupt, or attempt to disrupt the Service, its infrastructure, or other users' access.
• Attempt to manipulate, jailbreak, or circumvent the AI model's safety constraints, including prompt-injection attempts or coercive prompts intended to extract restricted output.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Create or use multiple accounts to circumvent the free trial, subscription limits, or any other technical or commercial restriction.
• Share, transfer, sell, sublicense, or otherwise make your account or access credentials available to any third party.
• Use the Service in any manner that violates the terms of the Apple App Store, Google Play, or any other distribution platform.

7.3 Enforcement

We reserve the right, at our sole discretion and without prior notice, to:

• Remove, refuse, or restrict any content.
• Suspend or terminate any account that violates these Terms, regardless of whether the violation is intentional.
• Refer matters to law enforcement when we believe a violation constitutes a credible threat or unlawful activity.

We are not obligated to monitor user content, but we may do so. Termination of your account does not entitle you to a refund of any prepaid subscription fees; refunds are governed exclusively by Apple's and Google's policies.

7.4 Reporting concerns

If you encounter conduct or content on the Service that violates these Terms, or if you believe your account has been compromised, contact us at contact@prediux.com.

8. Intellectual Property

8.1 Our property

The Service, including all software, design, text, graphics, the Prediux brand, and the AI prompt engineering, is owned by us and protected by copyright, trademark, and other applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

8.2 AI-generated content

The directives, plans, projections, and other text generated for you by the Service are produced by an AI model based on your inputs and the Prediux system prompt. You may use this output for your personal purposes. You may not republish, redistribute, or commercialize the AI-generated content without our written permission.

8.3 Your inputs

You retain ownership of the data you submit to the Service (signals, onboarding answers, free-text content). By submitting this data, you grant us a worldwide, royalty-free license to process it solely for the purpose of operating and improving the Service, as described in our Privacy Policy.

9. Service Availability and Modifications

We strive to keep the Service available continuously but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuance.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY OF THE AI-GENERATED CONTENT.

We do not warrant that the Service will meet your requirements, will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with your use of the Service, regardless of the legal theory.

In jurisdictions that do not allow such limitations, our total liability is limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the claim, or 100 euros, whichever is greater.

Nothing in these Terms limits liability for damages that cannot be excluded or limited by applicable law (including liability for fraud, gross negligence, or death or personal injury caused by negligence).

12. Termination

You may terminate your account at any time by emailing contact@prediux.com to request account deletion (a self-service deletion option is being added to the app).

We may terminate or suspend your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections 4, 8, 10, 11, 12, and 14 survive termination.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Spain, without regard to conflict-of-laws principles. The competent courts of Spain shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except where mandatory consumer-protection laws of your country of residence provide otherwise.

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
